Action Taken by Trial Court: Following a hearing, the workers’ compensation court found that the appellee had sustained an injury arising out of and in the course of his employment and was entitled to temporary total disability, permanent partial disability, future medical care, vocational rehabilitation (if needed), penalties, attorney fees, mileage, and medical expenses.
Assignments of Error on Appeal: The appellant contends that the court erred as a matter of law in finding that: (1) appellee’s injury arose out of and in the course of his employment and (2) awarding the appellee temporary and permanent benefits, past and future medical expenses plus mileage, a vocational rehabilitation evaluation and services, and penalties and attorney fees with interest.
