Case Summary

A-19-1090, Myron Morse and Lori Morse (Appellees) v. Kaylee Olmer (Appellant)

District Court of Platte County, Judge Robert R. Steinke

Attorney for Appellant: Jack W. Lafleur (Moyer, Moyer & Lafleur)

Attorney for Appellees: Erik C. Klutman (Sipple, Hansen, Emerson, Schumacher, Klutman & Valorz)

Civil: Grandparent Visitation

Action Taken by Trial Court: The district court determined that Appellees sufficiently demonstrated that a beneficial relationship existed between them and their grandchild; that it was in their grandchild’s best interests to have a relationship with them; and that visitation would not interfere with the parent-child relationship. The court awarded Appellees visitation with their grandchild on the first Tuesday of every month from 4:00 p.m. to 7:00 p.m. and on the third Saturday and Sunday of each month from 9:00 a.m. to 6:00 p.m.

Assignments of Error on Appeal: On appeal, Appellant alleges that the district court erred in (1) finding that the Appellees have a significant beneficial relationship with their grandchild; (2) finding that it was in the best interests of the child to have court-ordered grandparent visitation; (3) finding that grandparent visitation will not adversely interfere with Appellant’s relationship with the child; (4) failing to give special weight to Appellant’s decision-making authority; (5) failing to adequately consider the child’s father in making its decision; and (6) granting the petition for grandparent visitation.
