A-12-1020, State v. James R. Gintonio (Appellant)

Douglas County, Judge Gregory M. Schatz

Attorneys: Juliet A. Summers (Public Defender’s Office) --- Nathan A. Liss (Attorney General’s Office)

Criminal: Possession of a controlled substance; methamphetamine

Proceedings below: After overruling Appellant’s motion to suppress, the matter proceeded to a stipulated trial to the court. He was found guilty and sentenced 180 days in jail.

Issues: The court erred in denying Appellant’s motion to suppress evidence as there was an incomplete chain of custody and failure of authentication under Neb. Rev. Stat. § 27-901.
