Proceedings below: Rodehorst Bros. filed for a building permit to fix the roof on four-plex rental property owned by them. That permit was denied, with the Board of Adjustment further concluding that Rodehorst was no longer entitled to the nonconforming use of the property. Rodehorst Bros. filed a petition in error to the district court, which affirmed the decision of the Board of Adjustment. Rodehorst Bros. appeals.
Issues on appeal: Whether the district court erred in affirming the city's denial of Rodehorst Bros.'s building permit and finding that Rodehorst Bros. was no longer entitled to use the property in a nonconforming manner.
