Proceedings below: This case was previously before the Supreme Court. See Jeremiah J. v. Dakota D., 285 Neb. 211 (2013) (reversed and remanded for further proceedings). Upon remand, the county court found Dakota was equitably estopped from relying on Neb. Rev. Stat. § 43-104.02 and 43-104.04 and none of the factors in Neb. Rev. Stat. § 43-104.22 applied and thus, Jeremiah’s consent to the adoption was necessary.
