Criminal: First degree murder; use of a weapon to commit a felony

Proceedings below: After a trial to the court, Appellant was found guilty of both counts. He was sentenced to life imprisonment for first degree murder and five to ten years for use of a weapon to commit a felony.

Issues: The district court erred in (1) denying Appellant’s motion to suppress statements obtained from him in violation of his right against self-incrimination guaranteed by the 5th Amendment of the U.S. Constitution and Art. I, sec 11 of the Nebraska Constitution; (2) supporting a verdict based on insufficient evidence.
