Civil: Postconviction

Proceedings below: Appellant’s conviction and sentence was affirmed by this Court in State v. Robinson, 278 Neb. 212 (2009). Appellant filed his motion for postconviction relief. After holding an evidentiary hearing, the district court denied Appellant postconviction relief.

Issues: The trial court erred in (1) ruling Appellant’s counsel was not ineffective on direct appeal for failure to assign error as to the trial court; (2) ruling trial counsel was not ineffective for failure to object to the removal of jury instruction prepared by the trial court; (3) ruling that Appellant was procedurally barred from raising ineffective assistance of trial counsel.
