Civil Action:  Modification of paternity decree

Action taken by the Trial Court:  Spear filed a complaint to modify, seeking custody of the parties’ child. Schrag filed a counterclaim seeking to remove the child to New York. The trial court denied the removal request and granted Spear custody.

Assignments of Error on Appeal:  Did the trial court err in modifying custody? Did the trail court err in denying Schrag’s application to remove the minor child from the jurisdiction? Did the trial court err in removing the restriction for supervision of the child when she is with a particular individual? Did the trial court err in assessing child support against Schrag that was contrary to the evidence?
