Proceedings Below:  The district court granted summary judgment for Schijohn.  There being other parties and claims, the Court of Appeals dismissed Kelliher’s subsequent appeal for lack of a final order.  Schijohn then requested the district court release Kelliher’s lis pendens on the subject real property, which the district court granted.  Kelliher appealed that order.

Issues:  The district court erred in sustaining Schijon’s Application for Release of Lis Pendens as the lis pendens should remain in place until the appeal period is expired or exhausted regarding the adverse summary judgment ruling resulting in the dismissal of the action to quiet title to the subject real estate.
