S-13-0846, State v. Endre Turner (Appellant)

Douglas County, Judge James T. Gleason

Attorneys: Douglas A. Johnson (Public Defender’s Office) (Appellant) --- Stacy M. Foust (Attorney General’s Office)

Criminal: Count I: First degree murder; Count II: Use of a deadly weapon to commit a felony; and Count III: Possession of a deadly weapon by a prohibited person

Proceedings below: The jury found Appellant guilty of the crimes. He was sentenced to life in prison on Count I; 40 to 40 years on Count II and 3 to 3 years on Count III.

Issues: The trial court erred by denying Appellant’s motion to suppress and admitting his statement to police into evidence at trial as the statement was not voluntary in that it was the product of coercion, threats, and inducement of leniency made by police.
