A-12-0477, Donald Klingelhoefer (Appellant) v. Parker, Grossart, Bahensky & Beucke, L.L.P.

Buffalo County, District Court Judge John P. Icenogle

Attorney for Appellant:  David J. Lanphier (Broom, Clarkson, Lanphier & Yamamoto)

Attorney for Appellee:  Anne Marie O’Brien (Lamson, Dugan and Murray, LLP)

Civil Action:  professional malpractice

Action Taken by Trial Court:  The trial court granted defendant’s motion for summary judgment.

Assignments of Error on Appeal:  Donald alleges the district court erred in (1) granting defendant’s motion for summary judgment based on a finding that he lacked standing, (2) denying his motion to alter or amend the court’s previous ruling, and (3) requiring Donald to amend his complaint to allege a derivative action and then failing to allow him to present evidence as to damages.
