A-12-0470, State of Nebraska v. Rashad Washington (Appellant)
Douglas County, District Court Judge Peter Batallion
Attorney for Appellant: Daniel R. Stockman (Dunn & Stockman)
Attorney for Appellee: Jon Bruning, Kimberly A. Klein (Attorney General’s Office)
Criminal Action: First Degree Assault; Second Degree Assault; Possession of a Deadly Weapon by a Prohibited Person; Discharging a Weapon in Certain Cities, Villiages and Counties; Possession of a Stolen Firearm; Use of a Weapon to Commit a Felony (multiple counts)
Action Taken by Trial Court: Following a jury trial, appellant was found gulty of all nine counts. He was sentenced to 70 to 100 years’ imprisonment, but several days later attempted to modify the sentence. Upon appeal to this court we determined that the original sentence stood, but remanded the case for proper advisement of good time calculations. Upon remand from this Court, the district court informed appellant of his good time calculations based upon the sentences imposed on April 18, 2011.
Assignments of Error on Appeal: The appellant contends that the evidence was insufficient to support his convictions, the sentences imposed were excessive, and that he received ineffective assistance of counsel during the April 18, 2011 sentencing hearing.
