Proceedings Below: Ronald Vlach filed a declaratory judgment action seeking a declaration that no marriage ever existed between him and Rhonda Vlach. He claimed that no certificate of marriage was filed with the county clerk, as required by state law. The Dodge County District Court entered an order declaring that a valid marriage existed. The court also awarded attorney fees to Rhonda. Ronald appeals.

Issues: Ronald assigns the following errors, summarized and restated: the district court erred in (1) denying Ronald’s motion for summary judgment and finding that a valid marriage existed; (2) finding that a common law marriage existed between Ronald and Rhonda; and (7) awarding attorney fees to Rhonda.
