Criminal: Count I: Sexual assault; Count IV: First degree sexual assault and Count V: Incest

Proceedings below: A jury found Appellant guilty of the 3 counts above. He was sentenced on Count I: 20 to 25 years; Count IV: 20 to 25 years and Count V: 10 years. All were ordered to be served concurrently. Appellant’s motion for postconviction relief was granted finding that trial counsel failed to timely file a notice of appeal. The district court allowed a new direct appeal.

Issues: The trial court erred in overruling Appellant’s motion for disclosure of confidential information. Trial counsel was ineffective and provided deficient performance. There was insufficient evidence to support a conviction.
