S-12-1065, In re Guardianship of Brydon J. Pozela, Eric Lambrecht (Intervenor-Appellant) v. Sylvia Pozela (Guardian-Appellee)

Sarpy County Court, Judge Todd Hutton

Attorneys: Amy Sherman (Sherman & Gilner) (Appellee) --- Molly Blazek (Anderson Bressman PCLLO) (for Appellant, biological father Eric Lambrecht)

Civil: Guardianship; attorney fees

Proceedings below: The trial court found Appellee should have guardianship over the ward/minor child.

Issues: The trial court erred in awarding attorney fees to the Guardian’s attorney, to be paid by Appellant as there was no statutory basis for an award of fees.

Cross-Appeal: The trial court erred in denying Appellee’s request to be declared a person standing in loco parentis, awarding her the same rights as a natural parent and failing to award her sole legal and physical custody of Brydon.
