Criminal: Plea; DUI, 4th Offense

Proceedings below: The trial court accepted Appellant’s plea to the charge of DUI and found him guilty. After an enhancement hearing, he was sentenced to 3 years of probation, a $1000 fine, 90 days in jail and a 15 year license revocation. The Court of Appeals affirmed in a memorandum opinion, See A-12-0241, State v. Robert C. Taylor. Appellant filed a Petition for Further Review which was granted by the Nebraska Supreme Court.

Issues on Review: The Court of Appeals erred in affirming the district court.
