Criminal Action:  Aiding and abetting delivery of a controlled substance within 1000 feet of a school and attempted delivery of a controlled substance

Action Taken by Trial Court:  A jury convicted appellant of both of the above offenses.

Assignments of Error on Appeal:  Whether the district court erred in (1) overruling appellant’s motion to suppress, (2) finding sufficient evidence to the support the jury’s verdict and overruling appellant’s motion for directed verdict, and (3) overruling foundational objections to Officer Kozian’s testimony. Appellant also assigns that he received ineffective assistance of counsel.
