Criminal: Possession of a controlled substance.

Proceedings below: Appellant was found guilty and sentenced to 300 days in jail. The State of Nebraska filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.

Issues: The trial court erred in allowing the jury to re-hear Appellant’s recorded statement without a hearing to determine the purpose of hearing it again.
