S-13-0221, State v. Mathew C. Schuller (Appellant)
Lancaster County, Judge Karen B. Flowers
Attorneys: Melissa R. Vincent (Attorney General’s Office) --- Robert B. Creager (Anderson, Creager & Wittstruck, P.C., L.L.O.)(Appellant)
Criminal: Possession of Child Pornography, a Class III felony; 4th Amendment Search and Seizure
Proceedings below: Following a bench trial, Appellant was convicted of possession of child pornography. Motion to suppress evidence denied after suppression hearing.
Issues: The trial court erred in (1) denying Appellant’s motion to suppress evidence seized during a search of Appellant’s residence because the officer’s affidavit in support of the search warrant omitted information regarding the dynamic nature if IP addresses and (2) finding that the evidence was sufficient to support Appellant’s conviction.
