Criminal Action:  Criminal Mischief, Use of a Weapon to Commit a Felony

Action Taken by Trial Court:  A jury found Appellant guilty of the above offenses and determined the pecuniary loss was $7,500.

Assignments of Error on Appeal:  The district court erred in (1) failing to sustain Appellant’s motion to dismiss or in the alternative motion for directed verdict, (2) allowing a witness to testify as to the value of the damaged vehicle, (3) finding that the evidence was sufficient to determine the pecuniary loss at $7,500, and (4) failing to give a proposed jury instruction.
