Case Summary

A-20-550, Kier v. County of Hall

Melissa Kier and the Fraternal Order of Police (Appellants) v. County of Hall, Nebraska; the Sheriff’s Office Merit Commission of Hall County; Rick Conrad, Sheriff of Hall County; and the Hall County Sheriff’s Office (Appellees)

District Court for Hall County, Judge John H. Marsh

Attorney for Appellants: Thomas P. McCarty and Greg L. Young

Attorney for Appellees: Ashley Cornell and Pamela Bourne

Civil Action: labor relations

Action Taken by Trial Court: The district court upheld the decision of the Merit Commission which found that the collective bargaining agreements that govern the employment relationship precluded the sheriff’s office from preventing Kier from participating in the annual shift bidding process, but which also found that the sheriff maintained separate management rights over employees, including the right to transfer employees from shift to shift.

Assignments of Error on Appeal: Kier and the Fraternal Order of Police assign that the district court erred in (1) holding that the Merit Commission’s regulations take precedence over the shift bidding provsisions of the collective bargaining agreements; and (2) holding that the management rights provisions in the agreements take precedence over the agreements’ shift bidding provsisions.
