Action Taken by Trial Court: The district court issued a decree of dissolution of marriage ordering the following: (1) sole physical and legal custody of the parties’ minor child was awarded to Appellee; (2) Appellant was ordered to pay child support in the amount of $774.00 per month; (3) Appellant was awarded parenting time on alternating weekends from Friday after school through Monday before school and Wednesday evenings from after school until 8:30 pm in addition to the terms of the parenting plan agreed to by the parties; (4) real estate located on Florence Street purchased by Appellant before the marriage was to be sold with Appellant receiving the first $40,000 of the proceeds and the remaining proceeds divided equally; and (5) real estate located on S. 20th Street and H Street purchased during the marriage was to be sold with the proceeds from each sale to be divided equally.

Assignments of Error on Appeal: On appeal, Appellant assigns that the district court: (1) abused its discretion when it awarded sole physical and legal custody of the minor child to Appellee as its findings are not supported by the evidence and the award is not in the bests interests of the minor child; (2) erred in its calculation of child support; and (3) abused its discretion and erred in failing to make an equitable division of the marital real property in light of the substantial nonmarital nature of the properties and the length of the parties’ marriage.
