Case Summary

S-21-0657, Richard Muller (Appellant) v. Carl Weeder and Margene Cork (Appellees)

Appeal from the District Court for Boyd County, Judge Mark D. Kozisek

Attorneys:  Ryan D. Cwach (Birmingham Cwach Law Firm for Appellant) and Lyle J. Koenig (Koening Law Firm for Appellees)

Civil:  Substitution of parties; Mediation; Contempt

Proceedings below:  The county court permitted Appellant to substitute Appellees for the original Defendant in civil contempt proceeding.  On appeal to the district court, the district court dismissed the matter for lack of subject matter jurisdiction.  On its own motion, the Nebraska Supreme Court ordered this case be removed from the docket of the Nebraska Court of Appeals and transferred to its docket.

Issues: Appellant asserts the following sole assignment of error:  The District Court of Boyd County erred in concluding it did not have subject matter jurisdiction because the original Defendant died.
