Proceedings below: After a trial, the court terminated Appellant’s parental rights. The Court of Appeals affirmed. See Wayne G. v. Jacqueline W., 21 Neb. App. 551 (2013). Appellant filed a Petition for Further Review which was granted by the Nebraska Supreme Court.
Issues on Review: The Court of Appeals erred in (1) determining that termination was warranted under Neb. Rev. Stat. § 43-292(2); (2) failing to address the trial court’s error under Neb. Rev. Stat. § 43-292(5) in that the trial court violated the statute by not appointing a guardian ad litem and then subsequently determining that such statutory ground existed.
