Waiver of Parental Consent for Abortion for Minors

  • If you are under 18 and seeking to get an abortion in Nebraska without your parent or guardian’s permission, you need to file a Petition for Waiver of Parental Consent available below.
  • You can file the petition in person or by mail to any courthouse.  To find the courthouse nearest to you, check the map page https://supremecourt.nebraska.gov/courts/districts and click on the “Court Clerks” tab.
  • You can file the petition in any county in Nebraska. You don’t have to file in the county where you live.  If you choose to file your petition in person, every courthouse will have this form available for you to fill out.  
  • NEBRASKA SUPREME COURT RULES DO NOT ALLOW E-MAIL FILINGS FOR COURT CASES.
  • Individuals that do not have an attorney may file documents with the court in person, by mail, or by fax transmission. (Neb. Ct. R. § 6-601(B), allows non-attorneys to file any pleading, motion or other document, except for briefs in the appellate courts, by fax transmission until May 1, 2024.)
    • If you want to fax a court document, you must include the uniform cover sheet as the first page.  The fax must be less than 10 pages not counting the cover sheet.  If you want to fax more than 10 pages, you must get approval from the clerk of the court before you send it.
