Case Summary

A-17-509, State of Nebraska v. Orling A. Carrasco-Zelaya (appellant)

Douglas County, District Judge Horacio Wheelock

Attorney for Appellant: Thomas Campbell (TLNLaw)

Attorneys for Appellee: Douglas J. Peterson (Attorney General) and Nathan Liss

Criminal Action: Motor Vehicle Homicide, Leaving the Scene of a Personal Injury Accident Resulting in Death

Action Taken by Trial Court: After a bench trial, Carrasco-Zelaya was convicted of Motor Vehicle Homicide and Leaving the Scene of a Personal Injury Accident Resulting in Death. The district court later imposed a sentence of 20 to 30 years’ imprisonment for Motor Vehicle Homicide, and 4 to 4 years’ imprisonment for Leaving the Scene of a Personal Injury Accident Resulting in Death, to be served consecutively

Assignments of Error on Appeal: Carrasco-Zelaya assigns the district court erred in (1) failing to provide him with a fair and impartial trial, (2) overruling his motions and objections at trial and denying the him the opportunity to cross-examine witnesses to the same extent as the State, (3) and denying his motion for a new trial.  Carrasco-Zelaya also argues the evidence at trial was insufficient to support his convictions.
