Case Summary

A-21-479, Jeffrey R. Yost  (Appellant/Cross-Appellee) v. Shelley A. Yost (Appellee/Cross-Appellant)

Otoe County District Court, Judge Julie A. Smith

Attorney for Appellant:  Donald A. Roberts and Justin A. Roberts (Roberts Law, L.L.C.)

Attorney for Appellee:  Gregory D. Barton (Barton Law, P.C., L.L.O.)

Civil Action:  Dissolution of Marriage

Action Taken by Trial Court:  The district court entered a decree dissolving the parties’ marriage in June 2019. Over the next several years, the district court considered various motions to show cause, motions to compel, and motions to amend the decree filed by the parties. In May 2021, the district court entered an order, granting in part Shelley’s motion for new trial or to alter or amend the judgment and entering an amended judgment against Jeffrey.

Assignments of Error on Appeal:  Jeffrey has appealed assigning error regarding the district court’s failure to find Shelley in contempt for certain damages to property he was awarded, but which had been in Shelley’s control following their divorce; finding against him regarding certain dissipation of assets; and other issues related to property and contempt orders.

Shelley has cross-appealed arguing the district court erred in failing to value a business checking account in order to assess her claims that Jeffrey dissipated assets; allowing Jeffrey to retain certain funds without an offset; and alleging certain error in association with the court’s failure to include certain funds when determining the amount Jeffrey was required to pay her.
