Civil Action: Custody modification and child support

Action Taken by the Trial Court: Pursuant to a mediated parenting plan and court order, the parties previously shared joint legal custody of one minor child, and Appellant was awarded primary physical custody subject to Appellee’s parenting time as set forth in the parenting plan. Under that plan, the parties had a “seven-seven” parenting time schedule during the summer months and a “nine-five” parenting time schedule during the school year. Appellee filed a complaint to modify the parenting time schedule during the school year to establish a seven-seven parenting time schedule throughout the year. After trial, the district court granted Appellee’s requested modification, awarding the parties joint physical custody and establishing a year-round seven-seven parenting time schedule.

Assignments of Error on Appeal: Appellant assigns that the district court erred in (1) finding a material change in circumstances affecting the best interests of the child, (2) awarding the parties joint physical custody, and (3) changing the day and time of parenting time exchanges.

Assignment of Error on Cross-Appeal: Appellee assigns that the district court erred in failing to modify child support in light of the modification of physical custody.
