Criminal:  Deferred Sentencing

Proceedings below:  Appellant entered a guilty plea to Willful and Reckless Operation of a Motor Vehicle to Avoid Arrest, and he requested deferred sentencing pursuant to Neb. Rev. Stat. § 29-2922.  The district court denied this request and sentenced Appellant to eighteen (18) months of probation.  Appellant filed a Petition to Bypass the Court of Appeals, which the Supreme Court granted and ordered that this case to be transferred from the docket of the Court of Appeals to its docket.       

Issues:  Appellant makes the following assignment of error:  1) The lower Court erred in overruling Gnewuch’s Motion for Deferred Sentence pursuant to Neb. Rev. Stat. § 29-2922.
