Court of Appeals April Session - Attorney Notification
The Clerk of the Nebraska Court of Appeals sent the following notice to attorneys and self-represented litigants who are scheduled to argue before the Court of Appeals during the April 2020 session:
The Nebraska Court of Appeals is carefully monitoring the evolving circumstances presented by the spread of the novel coronavirus and the COVID-19 disease. Therefore, the Court of Appeals is considering submitting cases on the April 2020 Call without oral argument to limit exposure to the public and persons at higher risk of developing COVID-19 illness. These are cases scheduled to be heard on Tuesday, April 7, 2020, at the Nebraska State Capitol Building.
Counsel and self-represented litigants are reminded that:
- Any party, pursuant to Neb. Ct. R. App. P. § 2-111(B)(6), may elect to waive oral argument and submit the case only on briefs, unless otherwise directed by the court.
- The Court of Appeals may, pursuant to Neb. Ct. R. App. P.§ 2-111(B)(1)(a), order submission of any case without oral argument. In the event such order is entered, any party may file a motion requesting oral argument pursuant to the procedure in § 2-111(B)(1)(b).
