State v. Shiffermiller
Case Summary:
A-17-0675, State v. Steven F. Shiffermiller (appellant)
Lancaster County, District Judge Robert R. Otte -- Attorney for Appellant: Matthew K Kosmicki (Brennan & Nielsen) Attorney for Appellee: Douglas J. Peterson, Nathan A Liss (Attorney General’s Office)
Criminal Action: Possession of a controlled substance; Possession of a deadly weapon by a prohibited person.
Action Taken by Trial Court: The district court overruled Shiffermiller's motion to suppress evidence and statements taken during the detention and arrest of Shiffermiller. The court found Shiffermiller guilty of the above crimes.
Assignments of Error on Appeal: On appeal, Shiffermiller assigns that the district court erred in overruling his motion to suppress because (1) the police department exceeded the permissible scope and duration of a Terry stop, and (2) the warrantless search of his person violated the Fourth Amendment of the United States Constitution.
