Nebraska Court of Appeals Judge Frankie Moore Sits with Nebraska Supreme Court
Nebraska Court of Appeals Judge Frankie J. Moore of North Platte, was invited to sit with the Nebraska Supreme Court on December 4, 2023.
Moore heard arguments via video conferencing in the case of S-22-0967, Janet Palmtag (Appellant) v. The Republican Party of Nebraska a/k/a The Nebraska Republican Party (Appellee). In this case, Janet Palmtag was a candidate for the State Legislature in 2020, and after the Republican Party of Nebraska mailed out publications concerning Palmtag, she sued the Republican Party of Nebraska for defamation and false light claims. The district court dismissed her false light claim, and Appellee filed a Motion for Summary Judgment, which the district court sustained. Appellant filed a Petition to Bypass the Court of Appeals, which the Court granted and ordered this case to be transferred to its docket.
Moore heard arguments in place of Justice Jeffrey Funke, who was recused from the case.
Seven justices make up the Nebraska Supreme Court: Chief Justice Mike Heavican and six associate justices. On occasion, a justice must recuse him or herself from a case, and a judge from a district court or the Court of Appeals is asked to sit with the Supreme Court.
