Nebraska’s Language Access Committee, under the leadership of Justice Jeff Funke, completed an in-depth review of the Supreme Court Rules on Court Interpreters – specifically the requirements for certification and the interpreter disciplinary process. 

The review process began with an analysis of existing rule language and a full discussion of the Committee’s goals for rule revisions. The process culminated in amendments to interpreter certification and interpreter discipline rules, as well as the creation of a new character and fitness reporting requirement.

The intent of the revising the Interpreter Certification rule (6-704, 6-705, 6-706, 6-707), and adding a new Character & Fitness Reporting Requirement rule (6-710) was to clearly outline the potential impact of criminal charges and/or convictions on an individual’s eligibility to serve as a Nebraska court interpreter.

The revision of the Interpreter Disciplinary Process rule (6-708) establishes the authority for interpreter discipline rests with the Court Administrator and streamlines the process.  The revisions adopted by the Language Access Committee make clear the Court Administrator has complete and continuing discretion over the provision of interpreter services to Nebraska courts. Furthermore, it explains the Hearing Panel’s role is to make written recommendations to the Court Administrator, rather than to directly impose discipline.
