Proposed Rule Amendment: § 6-1453. Preliminary hearings in felony cases.

Proposed Rule Amendment: § 6-1453. Preliminary hearings in felony cases.

The Nebraska Supreme Court is considering amendments to Neb. Ct. R. § 6-1453. The rule provides the process for binding over to the district court preliminary hearings in felony cases that were heard in the county court and the process for requesting a “transcript of testimony.” The proposed amendment changes “transcript of testimony” to “transcript of proceedings,” so it is consistent with other Supreme Court Rules.  The proposed amendment also clarifies the process for requesting and preparing a transcript of proceeding.

The Nebraska Supreme Court will be receiving comments on the proposed amendment until October 1, 2024.

If you have comments you must submit them in writing to the office of the Clerk of the Supreme Court and Court of Appeals, P.O. Box 98910, Lincoln, Nebraska 68509-8910, or via email to joshua.shasserre@nejudicial.gov, with the rule number listed in the subject line.
