Self-Represented Paternity, Custody, Parenting Time, and Child Support Forms Created

The Self-Represented Litigation Committee has released a new forms module for the establishment of paternity, custody, parenting time, and child support.  The forms, long requested by self-help desks and libraries, are on the Judicial Branch Self-Help Website: www.supremecourt.nebraska.gov/self-help/families-children/establishing-paternity-custody-parenting-time-child-support

These forms and instructions are a result of the concentrated work of committee members: Judge Teresa Luther, Hall County District Court; Professor Kevin Ruser, UNL College of Law; Muirne Heaney, Access to Justice Coordinator at Legal Aid of Nebraska; and, Christina Werner, Judicial Branch Forms Coordinator.     

Instructions found on the website outline important criteria that must be met to use the forms. They are designed for a case

  • where there is NO existing court order for child support. (No DHHS order)
  • where the child’s other parent will be able to be personally served or will sign a voluntary appearance.
  • that is filed within 4 years of a child’s birth.

A case using the module will include:

  • A finding that a specific person is the child(ren)’s father (genetic testing is required);
  • An order for custody of the child(ren);
  • An order for parenting time with the child(ren);
  • An order for child support; and
  • An order for health insurance.

A parenting education class is required of both parties and a parenting plan will need to be completed.  Mediation may be required if a parenting plan cannot be agreed upon.

The module is designed for parents who have not been married but want to ensure access to their child(ren) while providing financial support.
