September 2020 Form Revisions and Additions
Forms Coordinator Christina Werner announced new and revised forms during September, 2020.
Guardianship/Conservatorship forms
Suggestions for revisions from judges, attorneys, court staff and the public were taken into consideration and the Guardian/Conservator Forms Committee made changes to the following forms:
- Order Approving Budget, CC 16:2.42. A line at the bottom of the budget table was added for the “Total” of approved monthly expenditures.
- Review 1 – Guardianships and/or Conservatorships, CC 16:2.57, Review 2 – Guardianships and/or Conservatorships, CC 16:2.58, and the combined form. Applied some of the suggestions by the Clerk Magistrates and refined some of the formatting.
- Annual document Review Worksheet (previous format), CC 16:2.43. This previously decommissioned form was revived, updated with current parameters and uploaded to the website.
- Interested Persons Update, CC 16:2.67. Added the page that includes the definitions of who an interested person is. This was added at the request of the specialists.
Garnishment forms
These changes were adopted by the Supreme Court on March 25, 2020, and effective October 1, 2020.
- Notice to Judgment Debtor, CC 3:8B. The Request for Hearing was moved to a separate form and the language regarding exemptions was clarified.
- Request for Hearing on Garnishment, CC 3:8.N. New form. This was removed from CC 3:8B. Includes language from Neb. Rev. Stat. § 25-1552 and space for an inventory of the debtor’s property in support for the claim of exemption.
Protection Order forms
- Protection Order Praecipe, DC 19:1. Changed “certified copy” to “copy.” The statutes do not require the copy to the respondent to be certified.
Administrative
Oath of Office – Clerk Magistrate, HR 2:17. “Judge” was added before “Notary Public” on the signature line.
Christina works with Judges, Clerks of District Court, Clerk Magistrates, and the Administrative Office of the Courts and Probation to provide forms to improve efficiency and consistency in the Courts and Administrative Offices.
