Action taken by the Trial Court: The trial court resolved a contract dispute between the Bhatts and Patels concerning a Nebraska corporation the Bhatts and Patels owned called Pragya, Inc. When a dispute arose between the parties, the Bhatts sought dissolution of Pragya. The Patels filed a counterclaim alleging, in part, that the Bhatts were delinquent on a promissory note. The trial court determined: (1) grounds for dissolution of Pragya did not exist; (2) the promissory note was a demand note due and owing upon its execution; and (3) the Bhatts were delinquent on their obligations under the note.
Assignments of Error on Appeal: Did the trial court err in concluding that the Bhatts were delinquent on the promissory note, determining the amount due and owing from the Bhatts to the Patels, and authorizing foreclosure of the note?
