A-19-0124, Michael and Cathy Christensen (Appellants) v. Beverly Sherbeck
District Court of Custer County, Judge Karin L. Noakes
Attorney for Appellants: David S. Houghton and Keith A. Harvat (Houghton Bradford Whitted PC, LLO)
Attorneys for Appellee: Daniel M. Placzek (Smith, Johnson, Baack, Placzek, Allen, Connick & Hansen)
Civil: Negligence arising out of an automobile accident
Action Taken by Trial Court: A jury rendered a verdict in favor of Appellee and against Appellants on Appellants’ claims arising out of an automobile accident involving their son and Appellee’s husband. Based on the jury’s verdict that Appellee’s husband suffered a sudden loss of consciousness prior to the collision, no damages were awarded to the Christensens.
Assignments of Error on Appeal: Appellants argue that the district court erred in admitting into evidence the medical opinions of two doctors retained by Appellee and in instructing the jury on the sudden loss of consciousness defense where there was not sufficient evidence presented at trial to support such a defense.
