17-0480, Cook v. Cook
Custer County, District Court Judge Karin L. Noakes
Attorney for Appellant: Nathan T. Bruner (Bruner Frank, LLC)
Attorney for Appellee: Michael S. Borders (Borders Law Office)
Action Taken by Trial Court: The district court found a stipulated parenting plan to be in the best interests of the parties’ children, but modified that plan to give the appellee final decision-making authority over the parties’ children. Further, the district court found the parties’ premarital agreement, which provided their present and future property would be separate during marriage, to be valid and enforceable. But the court held certain agricultural assets that appellant used to produce income and a line of credit secured by some of those assets to be marital property.
Assignments of Error on Appeal: The appellant assigns, restated, that the district court erred in (1) modifying the parties’ stipulation contained in the joint parenting plan and (2) including the agricultural assets and debt in the marital estate.
