Case Summary

A-24-0417 French v. Auto-Owners Insurance Co.

District Court of Platte County, Judge Jason M. Bergevin

Attorney for Appellant: George H. Moyer (Moyer & Moyer)

Attorney for Appellee:  Michael T. Gibbons (Woodke & Gibbons, P.C., L.L.O)

Civil Action: Insurance Policy Coverage

Action Taken by Trial Court:  The district court granted Appellee’s (Auto-Owners) motion for summary judgment after it determined that there was no genuine issue of material fact and that Appellant’s (French) claimed property damage was not covered under the insurance policy.

Assignments of Error on Appeal: Appellant argues the district court erred by (1)

sustaining the motion for summary judgment, (2) failing to consider the water service pipe from the main to the basement of Appellant’s hotel as an appurtenance to Appellant’s premises, (3) failing to consider the Utilities Failure endorsement as affording coverage, (4) failing to consider the Debris Removal rider as affording coverage, and (5) failing to consider the Backup From Sewers and Drains rider as affording coverage.
