A-17-0011, Lineweber (Appellant) v. Kruse & Remboldt Ludtke, LLP
Lancaster County, District Court Judge Lori A. Maret
Attorney for Appellant: Ray Lineweber (pro se)
Attorney for Appellees: Randall Goyette and Emily Motto (Baylor, Evnen, Curtiss, Grimit, & Witt, LLP)
Civil Action: Legal Malpractice; Fraud
Action Taken by Trial Court: The trial court granted summary judgment in favor of appellees Kruse and Remboldt Ludtke, LLP as to appellant Lineweber’s claims of legal malpractice and fraud. The trial court also found that appellant lacked standing to assert any claims on behalf of Brown Baggers, LLC. The trial court denied appellant’s request for a temporary restraining order compelling appellees’ clients’ records to be given to appellant. Appellant’s remaining claims were dismissed with prejudice because they were not cognizable claims for relief.
Assignments of Error on Appeal: Appellant assigns, summarized and restated, that the district court erred by (1) granting summary judgment for appellees and dismissing appellant’s claims of legal malpractice and fraud and other claims; (2) converting appellees’ motion to dismiss to a motion for summary judgment; (3) not reviewing all of the documents before it; (4) finding that appellant lacked standing to assert claims on behalf of Brown Baggers, LLC; and (5) admitting certain affidavits at the summary judgment proceeding.
