A-14-967, Marilyn J. Ludtke (Appellant) v. David A. Ludtke
Lancaster County, District Judge Andrew R. Jacobsen
Attorney for Appellant: David P. Kyker
Attorney for Appellee: Jane F. Langan Mach (Rembolt Ludtke LLP)
Civil Action: Dissolution of Marriage
Action Taken by Trial Court: The district court entered a decree of dissolution of marriage in which it incorporated the parties' partial property settlement agreement, denied alimony, ordered appellee to pay certain of appellant's medical expenses, ordered each party to pay his or her own attorney fees, and divided the parties' marital retirement accounts after reducing them for tax consequences; the district court subsequently overruled appellant's motion for a new trial or, alternatively, to alter or amend the decree.
Assignments of Error on Appeal: Appellant assigns that the district court erred in (1) failing to set aside the partial property settlement agreement and order a new trial on the basis that she was incompetent when she signed the agreement and at the time of trial, (2) determining that appellant's sale of certain property precluded her from challenging the partial property settlement agreement, (3) failing to award appellant alimony, (4) failing to order appellee to pay all of appellant's non-covered medical expenses, (5) failing to award appellant a reasonable attorney fee, and (6) adjusting the parties' marital IRAs for tax consequences before dividing them.
