Assignments of Error on Appeal: The appellant contends, inter alia, that the district court erred in: (1) denying his motion to recuse; (2) dismissing Pfanstiel from the lawsuit; and (3) granting the remaining defendant/appellees’ motion for summary judgment because genuine issues of material facts existed and Neb. Rev. Stat. § 25-1335 (Reissue 2016) operated to preclude summary judgment.
