A-22-226, Timothy J. Novotny (appellant) v. Nicole M. Novotny
Saunders County, District Court, Judge Christina M. Marroquin
Attorney for Appellant: Shane J. Placek (SidnerLaw)
Attorney for Appellee: Alex M. Lierz (Nebraska Legal Group)
Civil Action: Dissolution of Marriage
Action Taken by Trial Court: The trial court dissolved the parties’ marriage and divided their assets and debts.
Assignments of Error on Appeal: Timothy assigns that the district court erred in: (1) its application of Nebraska’s law related to tracing premarital assets; (2) disregarding his premarital assets including a savings account, 2016 net crop proceeds, and a 2015 Chevrolet Silverado; (3) imputing the yield from the parties’ marital agricultural property and disregarding the costs of inputs, taxes, labor, and risk in production of the 2021 crop; and (4) imputing the gross value of 2020 grain generally sold after the date of separation without consideration of tax consequences.
On cross-appeal, Nicole assigns that the district court erred in failing to (1) equitably divide the net marital estate, (2) order Timothy to reimburse her for the cost of his health insurance premium, and (3) order Timothy to reimburse her for attorney fees and expert fees.
