Case Summary

A-24-0677, In the Matter of the Estate of F.W. Eugene Clason; Steven E. Clason, personal representative of the Estate of F.W. Eugene Clason (Appellant) v. Susan J. Bayliss (Appellee)

County Court for Furnas County, Judge Jeffrey M. Wightman

Attorney for Appellant: Terry K. Barber (Barber & Barber, P.C., L.L.O.)

Attorney for Appellee: Jordan W. Adam (Fraser Stryker PC LLO)

Probate: Attorney fees; personal representative fees; final accounting

Action Taken by Trial Court: After Appellant filed a final accounting for the estate, Appellee objected to various requests for approval of payments by the estate. The County Court approved payment of certain attorneys’ fees incurred by the estate, but did not award interest on those fees. It also found merit to certain of Appellee’s objections for approval of payments and denied payment by the estate on those claims.

Assignments of Error on Appeal: On appeal, Appellant asserts that the county court erred in (1) failing to award a former attorney who represented Appellant in his capacity as personal representative with interest on his incurred fees; (2) denying Appellant’s request that the estate pay $200 for a truck rental; (3) denying Appellant’s request that the estate pay fees for the fertilization of land owned by the estate; (4) in denying Appellant’s request that the estate pay for a bill of exceptions requested by his current attorney; (5) in determining the fees owed to Appellant for his work as personal representative of the estate; (6) in allowing Appellant’s personal representative fees to offset a judgment owed in a separate case; and (7) failing to uphold Appellant’s assignment of his personal representative fees to his former attorney.
