Probate Action: Estate Proceeding wherein certain claimants filed a claim in Berniece Filsiger’s estate proceedings alleging she received about $200,000 more than she should have received in distributions from her late husband’s estate.
Action Taken by Trial Court: The county court granted summary judgment in favor of the co-personal representatives based upon its finding that the claim should have been filed as an improper distribution in the late husband’s estate proceedings.
Assignments of Error on Appeal: The appellants/claimants contend that the county court erred in granting summary judgment in favor of the co-personal representatives; in finding that the claim had to be filed in the late husband’s estate; and by failing to find that fraud had been perpetrated upon the appellants/claimaints.
