A-17-0218, In re Interest of Michael N., a child under 18 years of age. State of Nebraska v. Heather N. (Appellant) and Robert N. (Appellee and Cross Appellant)
Douglas County, Separate Juvenile Court Judge Elizabeth G. Crnkovich
Attorney for Appellant: Karen S. Nelson (Carlson & Burnett, LLP)
Attorney for Appellee and Cross Appellant: Kristina B. Murphree (Marks Clare & Richards LLC)
Attorney for Appellee: Donald W. Kleine, Jennifer C. Clark (County Attorney’s Office)
Juvenile Action: Detention Order
Action Taken by Trial Court: The juvenile court granted the Department of Health and Human Services continued custody of Appellant and Cross-Appellant’s minor child pending an adjudication hearing. The juvenile court also overruled Appellant’s and Cross-Appellant’s motions to dismiss the petition.
Assignments of Error on Appeal: On appeal, Appellant and Cross-Appellant both generally challenge the juvenile court’s decision to hold the detention hearing when they did not receive notice of that hearing and to overrule their motions to dismiss the petition. In addition, Appellant asserts that there was insufficient evidence presented to support the juvenile court’s order granting continued custody of her son to the Department.
