A-20-0482, Angela Richardson on behalf of William Earl See, Jr., a protected person (Appellant) v. OMNI Behavioral Health
Douglas County, District Court Judge Michael Coffey
Attorney for Appellant: Theodore R. Boecker, Jr. (Boecker Law, P.C., L.L.O.)
Attorney for Appellee: Dan H. Ketcham & Samuel A. Huckle (Engles, Ketcham, Olson & Keith, P.C.)
Civil Action: Negligence
Action Taken by Trial Court: The district court dismissed the action by granting summary judgment for appellee on vicarious liability and negligent entrustment.
Assignments of Error on Appeal: The appellant’s eight assignments of error relate to the appellant’s claims that the district court erred in granting OMNI’s motion for summary judgment (1) due to OMNI’s failure to file a statement of undisputed facts and (2) due to its failure to find that OMNI assumed a nondelegable duty and/or there remained material questions of fact including whether Martina Wall-Crawford was acting as OMNI’s agent at the time of the accident, whether the Walls or Martina Wall-Crawford maintained inadequate automobile insurance coverage, and that OMNI negligently allowed Martina Wall-Crawford to transport See. Richardson also contends that the district court erred in overruling Richardson’s motion to alter or amend or for new trial.
