Civil Action: Modification of Custody Agreement
Action Taken by Trial Court: The district court determined that the appellant did not establish that a material change in circumstances sufficient to modify the custody agreement had occurred. The court did determine that appellee established that a material change in circumstances occurred which warranted awarding her sole legal custody of the children. The district court further determined that appellant’s parenting time should be reduced.
Assignments of Error on Appeal: On appeal, the appellant assigns that the district court abused its discretion and erred in (1) reducing his monthly parenting time, (2) awarding appellee sole legal custody of the children, (3) declining to award him sole physical custody of the children.
