Criminal Action: Driving Under the Influence & Violating an Automatic Traffic Signal
Action Taken by Trial Court: On March 19, 2020, the county court of Lancaster county held a stipulated bench trial. After trial, the county court entered an order finding no conflict between Lincoln Mun. Code § 10.12.30 and Neb. Rev. Stat. § 60-6,123. The county court overruled Albarenga’s motion to suppress and motion to quash and ultimately found Albarenga guilty of driving under the influence and violating an automatic traffic signal. The county court suspended Albarenga’s driver’s license for 6 months and sentenced Albarenga to serve 7 days in jail and pay a $500 fine. Albarenga appealed the county court decision to the Lancaster County District Court, which affirmed in all respects.
